Terms and Conditions Agreement

Please read these terms and conditions carefully before using this service. I reserve the right to change these terms and conditions as I see fit.

DEFINITIONS:

“Service” refers to the fact that sales and inquiries may or will be taking place on and through brannarey.com.
"I, me, my, The Artist” will be used interchangeably throughout the agreement along with other self identifying terms.
"Art" will be used to define all artwork, jewelry and images I have ever created from 2024 to 1991 including any resale items I choose to have my Art printed on for my own sales purposes.
“brannarey.com” will be used to identify the portal and service where my Art is found and available for purchase online. Wix website builder powers brannarey.com.
“The Buyer” will be used to identify you, the buyer, the customer, the inquirer seeking a service through brannarey.com.
“Service” refers to my Art being marketed and sold from brannarey.com as well as my contact page on brannarey.com where inquiries and feedback can be sent to me by The Buyer.

I hold the copyright to all of my Art from their conception and inception including all works produced by me today or yesterday from 2024 to 1991 encompassing all physical and intellectual property and I reserve the right to duplicate and/or reproduce my Art for my own sales and purposes.

INTELLECTUAL PROPERTY:

All Art and other images used on brannarey.com such as logos and other visual or literary media (artist biography, artist statement, Art descriptions, etc.) have been created by me and are protected by the U.S. Copyright Laws.

RULES:

I do not authorize the duplication or reproduction for sales of my Art by any other human or computer whether accidental or purposeful.
I do not agree with AI usage of any of my Art and reject its use of my Art in any form or for any purpose.
I do not agree to NFT usage of any of my Art and reject its use of my Art in any form or for any purpose.
Do not use my Art for your events, sales, marketing, advertising or in any other form or for any other purpose without my consent.

If these rules are violated I reserve the right of termination (see below) and to justice through the U.S. Copyright Laws.

AUTHENTICITY DISCLAIMER:

All Art represented on brannarey.com is original and created by me. Each piece of Art purchased will be accompanied with a certificate of authenticity.

AS IS:

When the buyer completes a purchase through the services of brannarey.com, they are purchasing the Art as is. No refunds or returns or exchanges will be made by me or brannarey.com.

SALES:

All Art sold through brannarey.com can be purchased with acceptable government bank issued debit or credit cards or through Venmo with my Venmo account, brannarey. A link to Venmo will not be provided on brannarey.com. Once payment has been processed through brannarey.com and received by me, I will proceed with the shipping process.

SHIPPING:

I reserve the right to determine which carrier service to use when I ship Art to The Buyer. A shipping range cost has been added to the checkout and will automatically calculate shipping based on the total weight of all Art being purchased in a single transaction by The Buyer.

LIMITATION OF LIABILITY:

In the event of damaged, lost or stolen Art that was purchased by The Buyer, whether by accident or by fault of the shipping carrier, there will be no refunds or exchanges from me, The Artist, except in the event of termination (see below). I take care and have pride with my Art and will package each piece of Art to the best of my ability so the Art stays intact until the Art leaves my possession and continues its journey to The Buyer through a shipping carrier service.

TERMINATION:

Upon the event that The Buyer harasses or abuses me or my Art through brannarey.com or by other means of contact (social media, email, text, phone call, etc.) I reserve the right to terminate the transaction and refuse the current sale and all future sales to The Buyer.

CONTACT:

On brannarey.com the Testimonial page links The Buyer to email me directly through my business email contact: brannareyillustration@gmail.com. I will not use any other form of communication to respond to The Buyer when they contact me through the contact page on brannaey.com.

LINKS TO OTHER WEBSITES:

I am not responsible for the third party sites shown, listed, and linked on brannarey.com - Wix, MailChimp, LinkedIn, Instagram, Two Seasoned Artists, Venmo, Facebook, Voyage Utah, and Shoutout Arizona. The Buyer is responsible for agreeing or disagreeing with the separate terms and conditions or privacy policies provided by each third party site should The Buyer choose to click/follow the third party links.
